About the role:
We are looking to fill multiple positions through this recruitment with a specific focus on securing candidates that demonstrate the relevant skills and experience at the Grade IV level.
The NSW Crime Commission’s purpose is to disrupt, reduce and prevent the incidence of organised and other serious crime in New South Wales. The Commission is structured into several divisions, support teams and specialist units.
The Commission’s Legal & Confiscations Division exercises independent professionalism at all times, provides legal services (including litigation, strategic legal advice and general legal advice) to the Commission. Significant aspects of the work include conducting litigation in relation to confiscation proceedings under the Criminal Assets Recovery Act 1990; advising and appearing for the Commission in applications made pursuant to the Crime Commission Act 2012 in criminal proceedings; supporting the Commission’s criminal and financial investigations; advising on legal compliance; and preparing and making applications for statutory warrants on behalf of the Commission.
The Lawyer Grade III/IV is responsible for the conduct of a diverse practice including:
- having carriage of civil litigation matters, including providing strategic legal advice and direction, drafting correspondence, court documents and preparing evidence, engagement in settlement negotiations and preparation of matters for hearing.
advising and appearing for the Commission in criminal proceedings, or instructing the Crown Solicitor’s Office in relation to same, including applications pursuant to s 45(/(- of the Crime Commission Act 2012, subpoena matters, and applications for protective orders.
- advising and supporting the Commission to ensure that the Commission complies with all relevant legislation, policy and procedures.
- Advising and supporting the Commission in relation to statutory review and commissions of inquiry.
About You:
- Genuine interest in disrupting, reducing and preventing organised crime
- Ability to handle sensitive matters with integrity and professionalism
- Experience conducting complex litigation matters, including preparation of evidence and familiarity with civil practice and procedure
- Strong drafting, analytical and problem-solving skills
- Ability to manage a busy and diverse practice and support a growing team
- Experience appearing in courts in New South Wales or interstate
- Experience and/or interest in asset confiscation/forfeiture, financial investigations and crime preferred but not essential
- Law degree; admitted as a legal practitioner in an Australian jurisdiction that entitles unrestricted practise in NSW.
Security vetting:
You must be an Australian citizen to be eligible to work at the NSW Crime Commission.
The recommended candidates must be willing to participate in and secure appropriate security clearances by providing comprehensive details about their personal and financial interests and other relevant information about themselves, their families and their associates.
The Crime Commission Regulation 2022 under the Crime Commission Act 2012 stipulates that it is a condition of employment at the Commission that a member of staff obtain and maintain:
- a security clearance issued by the Commissioner, and
- a security clearance issued by the Australian Government Security Vetting Agency that the Commissioner determines is necessary for the position.
