The Department of Health plays a critical role in the Victorian health system and is responsible for shaping it to meet the health needs of all Victorians. We’re focused on

About the role:

The Public Law and Legislation Team provides strategic public law advice and legislation services for the health, ambulance services, mental health and ageing portfolios. This includes development of legal policy, primary legislation, regulations and legislative and other instruments for the Department's portfolio legislation as well as administrative law and other legal advice. The Team provides advice to the Ministers, Executive and department stakeholders including health related entities as required, including advice concerning the structure of entities in the Department's legislation. Legal compliance is a key function of the team and includes drafting delegations and authorisation. The team also provides legal representation for the Secretary in matters under the Crimes (Mental Impairment and Unfitness to be Tried) Act 1997.

Reporting to the Deputy General Counsel, Public Law and Legislation, the Public Law and Legal Governance Special Counsel will form part of the senior management team within the Legal and Governance Branch. They will provide expert, high level and specialist administrative law and legal governance advice to Ministers, the Secretary and the department on a range of public law issues while also providing oversight on the management of all administrative law matters within the branch. The Special Counsel will lead the branch in legal excellence and must continually adapt to deliver effective outcomes and solutions for the department and the State. They are required to build public service capabilities across the department and lead a team of legal professionals and be the subject matter expert across all public law and legal governance in the department. They will also be the lead specialist responsible for training, mentoring and supporting all lawyers within the unit and wider branch, as well as providing oversight to the department on all public law and legal governance risks as well as the legal and strategic management of Crimes Mental Impairment matters.

About you:

The successful candidate must hold (or be eligible to hold) a current practicing certificate under the Legal Profession Uniform Law (Vic).
Specialist expertise Minimum of 10 years post legal admission experience. Extensive leadership experience working within the provision of administrative law legal advice to government, along with strong statutory interpretation skills are required.
