Job Summary:
This role directs all contracting actions to win, negotiate, administer and close contracts geographically located and/or managed in the APAC region and the Global ground/range combat training on behalf of Cubic and their affiliates as well as parent company, with emphasis on Cubic Defence Australia (CDAus), Cubic Technologies Singapore (C-TECH), and Cubic New Zealand (CDNZ), as well as supporting other Defence Global efforts for Cubic Sweden and support to Cubic Italia. This position is the key Contracts business partner for Cubic’s senior leadership team for APAC and Global. Ensures compliance with applicable laws, regulations and contractual terms and conditions for assigned contracts. Manages complex, major systems (and services) prime contracts and related subcontracts to ensure that all requirements and obligations are fulfilled. Tasks include managing and submitting substantial proposals and leading negotiations, with authority in accordance with the OneCubic Authority Matrix and any supporting delegation. Together with the Project Management Team, proactively anticipates, identifies, analyzes and informs management of the financial, legal and performance risks that can impact success. Ensures Cubic continues to manage its contractual obligations (internal and external) and keep management informed regarding performance under assigned Contracts/Subcontracts. Contributes to setting department goals and objectives and works with department personnel in carrying out and measuring activities in support of these goals and objectives. Contributes to training department personnel in improving knowledge and expertise in contract management.
This position routinely exercises significant discretionary and substantial decision-making authority under limited supervision and direction, in close coordination with Cubic Defense headquarters in San Diego, California, U.S.A.
Essential Job Duties and Responsibilities:
Is the lead Contracts business partner to the senior leadership team
Act as the company's representative and deal with customer contract or acquisition managers.
Manage a contracts team, providing management, coaching, development and leadership in order to achieve strategic and operational objectives and ensure the team performs to a high standard.
Leads contracting actions to win, negotiate, administer and close contracts geographically located and/or managed in the APAC or other Global regions on behalf of Cubic and their affiliates as well as parent company (as assigned). Duties include: proposal planning, proposal preparation, evaluation, risk mitigation recommendations and negotiations of contract terms and conditions, management of contracts, and contract closeout, subject to the OneCubic Authority Matrix, including any supporting delegation.
Has contracts responsibility for the preparation of solicitations, negotiation and execution of key subcontracts under prime contracts located and/or managed in the APAC or other Global regions, including the oversight of such efforts conducted by any direct or sub-tier reports.
Provides professional and timely advice to Contracts department leadership, Business (or Strategic) Development, Program Management, Engineering, Business Unit leadership, Cost Estimating, and Legal on proposal preparation, review and submittal. Negotiates with customers, working directly with a team of cognizant functional department personnel in conducting the negotiations to assure the contracts achieve the company’s business objectives.
Ensures compliance with departmental and company-wide Contracts policies and procedures, as well as Cubic worldwide Policies, so that work performed meets legal, regulatory, contractual and Company requirements.
Keeps Contracts Department and cognizant functional and program managers informed of outstanding issues that may impact program, departmental and/or Company objectives for assigned contracts.
Reviews solicitation requirements and provides an independent risk assessment to Proposal/Program Managers and leadership as required, including the oversight such efforts conducted by any direct or sub-tier reports.
Identification of potential liabilities, risks, issues and disputes, arising with customers, suppliers, partners and third parties, and produce innovative mitigation plans.
Complies with any applicable import/export license requirements and ensures shipments of hardware, delivery of technical data, and the performance of related services and support are completed in accordance with Cubic’s Export Compliance Manual and Technology Control Plan.
Upon receipt of an executed contracting action, ensures that sales orders to authorize work be completed in an accurate, complete and timely manner
Supports advanced planning and other functions of the Subcontract Management Team (SMT) for assigned contracts/subcontracts.
Ensures compliance with and observes all legal / regulatory compliance requirements and practices, including (but not limited to) Australian statutes and regulations, particularly Foreign Corrupt Practices Act, and foreign government statutes and regulations for assigned responsibilities.
Remains current on legal/regulatory updates affecting contracts and agreements.
Manages and negotiates Non-Disclosure Agreements, sales representative agreements, reseller agreements, consultant agreements, teaming (and other strategic alliance) agreements, license agreements, escrow agreements, parent company guarantee agreements, Memoranda of Understanding/Agreement and similar Agreements in support of programs and opportunities assigned, including the oversight such efforts conducted by any direct or sub-tier reports, and appropriate senior leadership review and approval of strategic business relationships.
Oversees and coordinates Cubic's compliance with International Industrial Participation Requirements for assigned contracts.
Ensures that contract billings and payments are submitted and received in a timely manner. This includes follow-up on unbilled receivables or overage billings.
Resolves issues regarding contractual performance, including claims, changes, and terminations with little intervention from senior leadership.
Interacts with, confers, briefs, and makes recommendations to management regarding the progress and impact of potential contract and subcontract-related activities on the project. Prepares contract and subcontract reviews and reports on issues.
Prepares and manages contractual agreements and subcontracts; reviews and edits terms and conditions and flow-down requirements for contracts and subcontracts based on prime contracts consistent with company Legal and Contract policies.
Oversees project related subcontracts to ensure compliance with terms, including schedule and scope of work and is responsible for all subcontract incoming and outgoing correspondence
Ensures that contract databases, including the SAP enterprise management system (EMS), are updated in an accurate and timely manner.
Mentors personnel in Program Management, Engineering, Business Development, Quality and Material in Contracting law, regulation, compliance and process.
Position scope includes the responsibility to lead and develop less experienced team members and direct the work of others within the Contracts/Subcontracts function in the APAC and other Global regions.
Maintain positive and productive relationships with customers, professional advisors, partners and subcontractors.
Manage ad-hoc strategic projects as identified by department and senior company leadership.
Undertake regular liaison with the company's department and senior leadership team.
Integration and liaison with other Contracts teams within Cubic as required, and participate as an active member of the Cubic Defense Contracts Leadership Team.

Minimum Job Requirements:
Essential Requirement:
Degree qualified or equivalent in a technical or business-related discipline.
Knowledge of and experience in the Australian Standard for Defence Contracting (ASDEFCON) is a must.
Skills/Experience/Knowledge
12+ years-experience in contracts and subcontracts management.
Demonstrated leadership ability in Contract Management for high-value contracts for highly complex products and systems, which include development, service agreements, hardware and software installation and maintenance agreements etc., for both commercial and government agency customers.
Thorough knowledge of prime/subcontract formation and management activities, and proven ability to effectively negotiate complex terms, conditions and price involving major systems. Ability to provide workable solutions to address a wide variety of contractual challenges.
Must be able to prioritize assignments and meet deadlines with minimal supervision, working extended hours, as required.
Proven ability to manage, motivate and understand business priorities and requirements.
Ability to provide sound and strategic contractual and commercial advice.
High-level negotiation, contracts and subcontract management experience.
Sound financial management and document generation and control skills.
Demonstrated people management abilities, supporting and promoting a collaborative and cohesive Defence Contracts management team.
Desirable:
Experience in international contracts and subcontracts management.
SAP experience.
Familiarity and experience with the U.K. Defense Conditions (DEFCON) would be beneficial to the team
Personal Qualities:
Strong written and oral communication skills a must.
Possess interpersonal skills necessary to interact in extremely delicate, sensitive and/or complex situations dealing with Australian and foreign agencies and commercial customers.
Must be able to travel domestically and internationally.
Condition of Employment:
Successful outcome of a National Police Check.
Australia citizenship, and ability to qualify for an maintain and Australia Government security clearance.
