The position is responsible for providing commercial leadership by developing and negotiating contract packages whilst also overseeing contract administration. This position will lead the Engineering and Construction team’s work for all pre-contract and contract administration governance activities. The position will work closely with project teams, legal and procurement functions to ensure that suitable and timely commercial agreements are executed and administered to meet the project needs across both the development and delivery phases of a project. The position will provide commercial support and oversight as required during the construction phase to project teams.

Providing leadership, development and support to the commercial team, including the Contract Managers;

Managing the development of a delivery strategy, contract packages (SOW, schedules, key commercial particulars and operative term) as part of the contracting process for E&C activities during the development phase including:

determining with the Procurement team the appropriate tender process;

determining appropriate commercial structure and form of contracts together with Legal team;
-
reviewing tenderer contract departures and deciding E&C’s position for negotiations;

managing the negotiation process, together with project team, legal and procurement and other internal functions;
-
leading negotiations with suppliers, consultants, contractors and partners particularly for scopes, key commercial terms and contract schedules; and

managing the contract execution process

Oversight of contract management during the construction phase, including reviewing monthly contract reports to assess any commercial risks to Acciona Energia, including any potential issues with existing strategic relationships.

Stakeholder management and advocacy across the business, particularly developing relationships with Legal and Procurement teams.

Developing and promoting the use and implementation of the Commercial Management Plan for the commercial team and promoting the role of the commercial team across the business

Ensuring commercial governance across all projects, including compliance with the delivery strategy, management of the tender gate process and implementing negotiation mandates.

Implementing new processes or initiatives as required to achieve E&C’s strategies or where there are opportunities to improve.

Setting up contract administration processes for executed contracts and support the project team to administer contracts.

Support the development of commercial strategies for all E&C activities in projects.

Identify key commercial terms and be able to focus on the team on these.

Provide commercial leadership to E&C team for pre-construction activities.

Understand the internal requirements for preparing, negotiation and executing third party contracts and ensuring E&C complies with these requirements

Understand and manage the requirements of financial closure/FID/Ready to Build and develop plans for achieving this milestone.

Identify areas for areas for business improvement and implement new processes and systems to effectively manage growth in the business

Be active in relevant industry forums and represent ACCIONA’s interests

Keep up to date and abreast of industry factors that may impact on the business.

Maintain and foster relationships with suppliers and subcontractors, clients and other business contacts.
Required Skills and Competencies

Degree in Business, Commerce, Law, Engineering, Construction or related discipline.

10+ years’ experience in commercial, contracts or project delivery roles.
-
Experience leading commercial teams on major construction, infrastructure or energy projects.

Strong contract negotiation, administration and commercial risk management skills.
-
Proven ability to develop commercial strategies and manage governance processes.

Excellent stakeholder management skills and experience working with Legal, Procurement and Project teams.
