About the Role
The purpose of this role is to receive, respond and effectively resolve pre-litigation and litigation disputes raised by customers. Pre- litigation includes receiving, actioning, responding to and resolving requests for review of service provider/Scheme Agent liability and work capacity decisions on workers compensation claims. Litigation includes all litigated matters before the Workers Compensation Commission (WCC) and the Courts involving work capacity decisions and where needed, provide support to the Dispute Resolution and Litigation Leaders on all other litigated matters before the WCC. The role will also be responsible for liaising with the Dispute Resolution and Litigation Leaders to determine litigation strategies on all pre-litigation and litigation matters to ensure they are managed in accordance with business objectives, liaising with the Dispute Resolution Manager when necessary to ensure legal issues are managed in accordance with the policies of the Board and the icare executive and developing and implementing opportunities to continually improve and enhance services to our customers.

Duties
It’s an exciting time at icare where no two days are the same: as Sr Litigation Specialist you will:
- Guide specialists to effectively manage and respond to requests for internal review by an insurer of liability and work capacity decisions on workers compensation claims.
- Guide specialists to manage and respond to applications to resolve a dispute before the Workers Compensation Commission and other litigation before the Courts.
- Assist and support the team in the completion of quality reviews of liability and work capacity disputes within legislated timeframes.
- Drive successful outcomes and avoid unnecessary disputes.
- Use and update the relevant claims management and customer relationship systems.
- Work with team and other internal stakeholders to achieve positive customer outcomes.
- Promote positive working relationships with external stakeholders.
- Guide and determine when to engage, instruct and manage legal provider services performance on pre-litigation and litigation matters.
- Engage with, consult and manage communications (including settlement options/litigation strategy) with our service providers/Scheme Agents and impacted stakeholders.
- Ensure the team meets legislated timeframes and actuarial targets.
- Respond to, lead and facilitate education on precedents and emerging trends on pre-litigated and litigated matters.
- Research and prepare position papers for consideration in making scheme-wide policy decisions resulting from reviews of decisions on workers compensation claims or proposed changes to regulation and legislation.
- Engage with and foster key external relationships to ensure effective engagement with the icare business model.
- Keep abreast and ahead of litigation and decision-making trends to ensure that potential impacts are anticipated and managed.
- Participate in customer experience programs that contribute to the delivery of improved outcomes for employers in workers insurance.
- Partner with other icare streams to support the achievement of business objectives.
- Identify and report on trends and opportunities to improve customer experience and to enhance the service of icare.
- Ensure all decisions are based on the model litigant policy.
- Devise and implement strategies to actively manage claims filed in the Workers Compensation Commission and to ensure control and improvement of work injury damages and common law liability for the scheme.
- Manage, monitor and measure the scheme wide impact of the outcomes of litigation.
- Making recommendations regarding any relevant operational responses and potential changes to scheme valuation.
- Research and prepare position papers on specific litigation or proposed changes to regulation impacting workers compensation claims when necessary.
- Assisting with drafting operational reports, board reports and briefing notes on contentious matters.
- Continue to assist with the implementation of the icare claims model and ongoing collaboration with our Service Providers.
- Engage and foster kept external relationships to ensure effective engagement with the icare business model.
Skills & Experience
- Comprehensive understanding of workers insurance legislation and soundly based decisions
- Extensive experience in alternate dispute resolution/litigation in insurance related matters
- Ability to adapt to change in the insurance industry and economic environment
- Ability to tailor communications and approach to the specific customer
- Passionate about providing quality service and outcomes to our customers with a focus on empathy
- Extensive experience in workers compensation related matters (including litigation) in private practice or government.
- Extensive experience in claims management including management of litigation.
- A broad range of experience in relationship management.
- Ability to adapt to change in the insurance industry and economic environment.
- Ability to tailor communications and approach to the specific customer.
- Excellent relationship management and interpersonal skills
- Excellent oral and written communication skill.
