About the role:
This is an exciting opportunity to progress your career and obtain experience working as a Supervising Lawyer in the Specialist Legal & Litigation Division of Legal Services, Victoria Police. Legal Services provides legal services and advice to support policing, courts, and the Victorian community. Legal Services is led by an Executive Director (who is also the organisation's General Counsel) and employs over 800 staff spread across four divisions – the Office of the Executive Director; the Specialist Legal and Litigation Division; the Courts & Prosecution Services Division; and the Legal Business Operations Division.
This position reports to the Managing Principal Lawyer (Confiscations) of the Criminal Investigations and Confiscations Legal Unit (CICLU).
CICLU sits within the Specialist Legal and Litigation Division of Legal Services. The Division provides specialist legal expertise in support of Victoria Police's operational and business activities.
Your primary responsibility is to advise and assist the Criminal Proceeds Squad, and Victoria Police more generally, on all aspects of the Confiscation Act 1997 (Vic) (Confiscation Act). This includes advising on police investigations and court proceedings, reviewing confiscation matters prior to referral to the Proceeds of Crime Directorate at the Office of Public Prosecutions and conducting litigation on behalf of the Chief Commissioner of Police.

Your duties will include:
- Promoting the integrity of Victoria Police and Legal Services

Providing expert legal advice to the Criminal Proceeds Squad on a variety of complex and sensitive matters

Preparing court applications under the Confiscation Actg. Restraining Orders, Unexplained Wealth Restraining Orders, Civil Forfeiture Restraining Orders, Freezing Orders

Preparing applications relating to information-gathering powers e.g. Information Notices, Production Orders
-
Appearing in the Magistrates' Court of Victoria on behalf of the Chief Commissioner in confiscation proceedings

Self-management of case load and service delivery requirements
-
Maintaining professional relationships with internal partners and external stakeholders
-
Manage complex and sensitive information with due regard
As the successful applicant, you will have:
- The ability to independently review, manage and conduct complex and sensitive confiscation proceedings in the Magistrates' Court of Victoria

Knowledge of relevant legislation and experience in oral/written advocacy.

Experience in providing highly specialised legal advice (both oral and written), and a clear understanding of the implications of decisions made on the basis of that advice

Demonstrated ability to simultaneously work on multiple complex files

Experience in performing legal research with the ability to identify and deal with critical legal issues

Strong interpersonal skills, including high levels of emotional intelligence, self-awareness and resilience
-
A current unrestricted practising certificate or be eligible to obtain one
Demonstrated experience in civil litigation and/or criminal law (with a particular emphasis on proceeds of crime/asset confiscation) would be highly desirable.

One (1) x full-time, fixed term until 8 October 2027 position available.

The salary range for a VPS5 role is $116,413 to $140,849 (covering salary ranges VPSG5.1 and VPSG5.2). Although it is standard practice for selected candidates to commence at the base of the salary range, genuine consideration will be given to a commencement salary within the available range that is commensurate with the successful candidate's knowledge, skills and experiences. This will be subject to negotiations with the Hiring Manager in the course of the selection process and may include the provision of evidence of a higher income and/or supporting documentation (as required).

This position is located at Victoria Police Centre, 311 Spencer Street, Docklands.

The successful applicant will be required to undergo National Security Vetting, achieve and maintain a security classification as determined by the Department Head. To achieve this, applicants must be an Australian Citizen.

The successful applicant will be required to undergo pre-employment checks which may include fingerprint checks and misconduct screening.

As a member of the Legal Services Department you will be located, on selection, at a specific office within a Division for a particular advertised opportunity. However, given occasional legal service demand issues you may be required at times to undertake varied work within the Department.
