About the Team
The Enforcement Team aligns with the Commission’s provider supervision and regulatory models, conducting investigations into alleged serious non-compliance with the Aged Care Code of Conduct and other conditions of registration relating to regulated entities (registered providers, responsible persons and aged care workers) obligations under the Aged Care Act 2024 and the Aged Care Rules 2025. The team focuses on enforcing compliance through various regulatory actions to hold providers and workers accountable for their conduct.
About the Role
The Assistant Director, Enforcement is responsible for leading and conducting complex enforcement investigations with minimal supervision which will involve serious non-compliance with relevant provisions, which are likely to require a civil, criminal or other high level enforcement response.
Additionally, the Assistant Director, Enforcement leads a small team of Senior Investigators, providing leadership, direction and expert advice on civil, criminal and administrative enforcement matters. Older persons in receipt of aged care are some of the most vulnerable people in the community. As an Assistant Director, Enforcement, you will perform your duties with sensitivity, understanding that you will encounter material and information that may be quite confronting and distressing.
Position Duties
Lead, manage and mentor a team of Senior Investigators undertaking Enforcement investigations and provide expert advice and assistance in relation to civil, criminal and administrative matters.
Under broad direction, lead very complex and sensitive investigations, with minimal supervision, into the conduct and suitability of approved aged care providers, responsible persons and aged care workers, ensuring a high level of accountability and quality to support civil, criminal or administrative responses.
Prepare detailed evidence briefs to initiate civil penalty proceedings in the Federal Court and criminal prosecutions through the Commonwealth Director of Public Prosecutions.
Collaborate effectively with legal officers and other advisors under broad direction to develop effective compliance and enforcement strategies, acting as the primary liaison with external counsel on enforcement matters.
Lead and provide specialised advice to a team of investigators in recognising the care needs of aged care recipients during enforcement investigations and support their participation through well-structured interviews, detailed statements, affidavits, and comprehensive evidence collection including through the use of statutory notices.
Manage the secure collection, storage, and handling of evidential material and protected information gathered during investigations and other regulatory activities, ensuring compliance with relevant policies and procedures.
Handle sensitive and potentially distressing material with professionalism and empathy, maintaining emotional resilience and conduct all investigative activities with a focus on the well-being and dignity of everyone involved.
Produce high-quality investigation reports that provide clear, evidence-based insights to inform regulatory responses and support sound decision-making on remedial actions.
Demonstrate strong negotiation skills by anticipating other parties' perspectives, presenting positions effectively, and strategically resolving complex matters, including advocating for enforcement outcomes based on evidence and engaging with stakeholders to achieve agreeable outcomes.
Develop and maintain productive stakeholder relationships with external agencies, including the CDPP and other authorities, to support collaborative regulatory outcomes.
Apply significant evaluative judgement by interpreting legislative intent and applying legislation to achieve regulatory outcomes, while making well-reasoned and strategic investigative decisions that support both enforcement outcomes and broader organisational objectives.
Apply in-depth specialist knowledge of statutory, regulatory, and policy frameworks including the Aged Care Act 2024 and Regulatory Powers (Standard Provisions) Act 2014 to conduct Enforcement investigations and provide authoritative advice on very complex investigative matters.
Hold or be eligible to obtain, appointment as an Authorised Commission Officer (ACO) to undertake field-based duties, subject to meeting all statutory and eligibility requirements.
Position Eligibility Requirements (Selection Criteria) :
To be successful in this role you will need to demonstrate the following:
Proven ability to independently lead end-to-end complex enforcement investigations, applying contemporary enforcement methodologies, including conducting interviews and preparing statutory notices, to achieve quality outcomes with accountability and integrity.
Demonstrated ability to lead, coach, and develop a high-performing, geographically dispersed team, building enforcement capability and delivering results in a complex regulatory environment.
Advanced skill in producing high-quality reports and evidence briefs that support regulatory and enforcement objectives and inform decision making.
Proven experience in interpreting and applying legislation, with the ability to rapidly acquire and apply knowledge of aged care statutory, regulatory, and policy frameworks such as the Aged Care Act 2024 and Regulatory Powers (Standard Provisions) Act 2014.
Demonstrated ability to manage sensitive and complex information with composure and empathy, maintaining resilience while ensuring actions uphold respect, fairness and dignity and wellbeing of all involved.
Advanced communication, negotiation and influencing skills, with the ability to build and maintain productive relationships with a diverse range of stakeholders, navigate complex interactions by effectively presenting arguments, understanding different perspectives, and driving outcomes that achieve objectives.
Demonstrated ability to oversee the management of confidential and protected information and evidence with accuracy and confidentiality, ensuring processes align with relevant policies, procedures and obligations.
Demonstrated ability to operate independently under broad direction, applying professional judgement, analytical thinking and evidence-based approaches to resolve complex issues.
Strong capability in identifying opportunities for continuous improvement, implementing change to achieve quality outcomes, and supporting staff through change initiatives.
Ability to obtain Authorised Commission Officer approval in line with Commission policy and to meet obligations in respect of statutory powers, suitability requirements and responsibilities associated with field-based duties, including any travel.
Role Specific Requirements:
Occasional interstate/intrastate travel may be required (applicable travel expenses are covered under the Commission’s travel policy).
Required to provide evidence of seasonal influenza and COVID-19 vaccinations.
Current drivers licence (unrestricted).
Mandatory Qualifications:
Qualifications related to enforcement (for example, A Diploma in Government Investigations; a degree in policing studies; a degree in justice studies, criminology or legal studies; a degree in intelligence and security; a Bachelor of Laws; or equivalent)
Desirable skills and experience:
Understanding of the Australian aged care system and the regulatory legislation underpinning it.
Significant experience with another Government agency responsible for enforcing legislative frameworks in a regulatory environment
Position Notes:
Salary offered will be between $122,620- $139,850 +15.4% superannuation per annum depending on skills and experience. In addition, 15.4% superannuation will be paid.
