The Position
An exciting opportunity has developed for lawyers with 1-2 years' experience in Commercial Litigation to join our successful and growing team. With a fast-growing division, with no shortage of work, the position offers enormous potential for personal and professional growth, and access to an abundance of support and expertise available within our organisation and leading commercial litigation team.
We offer work as a ‘whole project’ approach, providing expert services from inception to delivery and completion. The position is based in our stunning Sydney CBD office which boasts glass walls allowing ample natural light, impressive board, and meetings rooms, lots of break out spaces, open plan seating and ad hoc hybrid working arrangements.
The role involves working alongside and reporting to a dedicated Partners and Senior Lawyers of considerable skill, you will undertake a variety of legal work, predominantly:
Duties & Responsibilities
1. Responsible for the day-to-day conduct of files in the Commercial Litigation division;
2. Taking initial and ongoing instructions from clients;
3. Drafting advices, correspondence and all general Commercial Litigation documents;
4. Advocacy and preparation of court matters;
5. Instructing and liaising with barristers, experts and consultants as required;
6. Attendance at client meetings, file related meetings, business development meetings, exchanges, settlements;
7. Attendance at client functions;
8. Assisting with the compilation and submission of capability statements and tenders;
9. Direct liaison with clients and building client relationships;
10. Liaising with clients, client’s consultants, solicitors, conveyancers, banks and other third parties;
11. Drafting and facilitation of regular e-alerts and Commercial Litigation updates/articles;
12. Management and responsibility for professional fees and disbursements in relation to files;
13. Mentoring, training, supervising and motivation of solicitors, graduates, support staff and interns;
14. Assist with work overflow as directed by Commercial Litigation Divisional Leader and/or Director, as and when required;
15. Comply with client service requirement of 24-hour turn-around;
16. Drafting, reviewing and provide all assistance required with respect to compiling the Commercial Litigation precedents;
17 Comply with Quality Control Manual Procedures;
18. Marketing the Practice and Business Development.
Skills and Experience
To be successful in this role you will have:
1. A Bachelor of Laws or equivalent degree and hold a current practising certificate;
2. A minimum of 1-2 years’ PQE working as a legal practitioner in commercial litigation including but not limited to:
- Dispute Resolution regarding:
- Loans, mortgages, guarantees, financial or all forms of contracts;
- Business, partnership, shareholder or board disputes;
- Joint venture or estate disputes;
- Defamation and reputational risk disputes;
- Commercial retail lease disputes (tenants or landlords), options to purchase land
- Personal or corporate insolvency advice (bankruptcy, voluntary administration, receivership and liquidation), for the insolvency appointee, creditor or debtor;
- Representation with professional sporting contracts;
- Construction disputes.
- Insolvency and restructuring; and
- Debtor and creditor disputes.
3. Mentoring skills – the candidate may be required to manage lawyers from time to time;
4. General capability in contract-based commercial litigation;
5. Strong and strategic negotiation and dispute resolution skills as well as the ability to provide professional and cost-effective legal services;
6. Drafting experience and capability to conduct chamber matters and trials, with counsel;
7. Strong research and analysis skills with an ability to apply critical thinking;
8. Dedication to providing excellence in client services;
9. Excellent written and verbal communication skills and flexible approach;
10. Capacity to be self-managed and be self-motivated;
11. Mid-top tier experience would be ideal.
